VANCE COUNTY, N.C. - A Vance County family is left angry after a deputy avoids serious charges for repeatedly slamming their middle schooler last week.

A surveillance camera captured the altercation, which is now making national headlines.

The DA says because the victim didn't suffer serious injuries the former SRO will only get charged with misdemeanor child abuse.

An arrest warrant is now out for Warren Durham, who faces up to 120 days in jail if found guilty.

The violent video was leaked last week. Authorities say it showed Durham slamming an 11-year-old boy in the hallway at Vance Middle School.

DA Mike Waters says he still doesn't know what led up to the altercation, but says that doesn't matter.

Waters says nothing justifies treating a child like that. He says Durham will never again serve as an officer.

Spectrum News spoke with the victim's family. The grandfather says his grandson still suffers from head pains.

According to him, the boy had a CT scan and will go back to the hospital for more tests.

He added that his grandson will no longer return to the school and the boy currently has trouble trusting officers.
